TERMS OF USE
Your access to and continued use of the Tourism Windsor Essex Online Photo Gallery constitutes your acceptance of and compliance with the following terms (the Terms of Use). All rights (including but not limited to copyright) in the photographs, videos and any other such digital material featured on the Site (collectively referred to as “the Content”) are owned by the Tourism Windsor Essex Pelee Island or have been licensed to Tourism Windsor Essex Pelee Island.
The Content is available on the Site for you (the User) to review in order to determine its viability for use in accordance with the Terms of Use. The User is granted a personal, non-transferable, non-exclusive, non-commercial licence to use the specific content that is the subject of the approval (the Media) in accordance with the Terms of Use and any subsequent or additional terms that may be communicated to the User by Tourism Windsor Essex Pelee Island.
The Media may be used only for the purpose of promotion of Tourism Windsor Essex and only in the manner specified in the User’s online request and in accordance with the digital rights set out in the metadata associated with the Media (the Associated Digital Rights), which can be found on the Image Preview page(s). Approval to use the Media is granted for one-time use only and any subsequent or additional use of the Media must be requested separately.
Subject to this section, the Media should not be manipulated in any way. The Media format may only be modified as necessary to allow for its use in materials as specified in the User’s online request and in accordance with any restrictions contained in the Associated Digital Rights. The Media content must not be altered in any manner including, but not limited to, superimposing, tinting, significant cropping, or the removal or addition of building, persons or any other content.
Credit for use must be given as “© Tourism Windsor Essex” or as otherwise set out in the Associated Digital Rights. Tourism Windsor Essex Pelee Island shall not be responsible or liable for any damages, whether direct, indirect, incidental, special, consequential or other damages arising out of or in connection with the Site, use of the Site, the Content or the Media.
The User agrees to indemnify Tourism Windsor Essex Pelee Island against any claims, damages, costs, and fees arising out of the User’s improper use of the Content or the Media and/or a breach of any of the Terms of Use.
The Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein and the parties hereby agree to attorn to the jurisdiction of the Courts of Ontario.
